ÖZET<br/>İnsan sağlığının korunması ve iyileştirilmesi tıbbın en temel amacıdır. Hekimler, <br/>mesleğini birtakım hak ve yükümlülükler çerçevesinde icra ederler. Literatürde hasta <br/>haklarına yönelik birçok çalışma yer almakla birlikte tıbbın temel taşı olan hekimlere <br/>yönelik haklar sınırlıdır. <br/>Hekime tanınan haklardan biri olan hastayı seçme veya reddetme hakkı ayrımcılık <br/>yasağına aykırı kullanılamaz. Özellikle, hekime yönelik şiddet olaylarına karşı <br/>hekimin bu hakkı kullanması, mesleğini daha uygun koşullarda yerine getirmesini <br/>sağlayacaktır. Buna bağlı olarak, diğer hastaları ile daha sağlıklı şekilde iletişim <br/>kurmasına ve tedavinin gidişatına karar vermesine yardımcı olacaktır. <br/>Bu çalışmada, ulusal ve uluslararası mevzuat ile KKTC’deki yargıtay kararları <br/>doğrultusunda yasalarıyla birlikte yargıtay kararları doğrultusunda, hekimin hastayı <br/>seçebilme hakkı incelenmiştir. Bu kapsamda, hekime tanınan bu hakkın hekim ve <br/>hastalar açısından önemi ve hakkın sınırlarıyla birlikte cezai boyutu irdelenerek hakkın <br/>kullanılış şekli hakkında çalışma yapılmıştır. <br/>Anahtar Kelimeler : Hak, Hekim Hakları, Hekimin Hastayı Ret Hakkı, <br/>Hekimin Tedavi Özgürlüğü, Hasta-Hekim İlişkisi. |

ABSTRACT<br/>Ptorection and improvement of human health is the most basic aim of medicine. <br/>Medical practitoners perform their profession within the framework of certain rights <br/>and obligations. Although there are many studies on patient rights in the literature, the <br/>right of medical practitioners, which are the cornerstones of medicine, are limited.<br/>The right to choose or rejectmthe patient, which is one of the rights granted to the <br/>medical practitioner, cannot be used contrary to the prohibiton of discrimination. In <br/>particular, the medicine practitioner’s use of this right against the acts of violence will <br/>enable him to perform his profession under more favorable contidions. Accordingly, <br/>it will help him to comminicate more healthy with his patients and to decide on the <br/>treantment process.<br/>In this study, the right of the medical practitioners to choose the patient has been <br/>examined in line with the national and international legislation as well as the Suprame <br/>Court decisions in TRNC. In this context, the importance of this right, which is granted <br/>to medical practitioners and patients, also the punitive perspective together with the <br/>limits of the right have been examined.
