ÖZ<br/>Kasten öldürme suçu, insanlık tarihi kadar eskiye dayanmakta olup, eski hukuk <br/>dönemlerinde Roma, Mısır, İbrani ve İslam hukuku gibi hukuklarda yer almıştır. <br/>Osmanlı döneminde ilk olarak Fatih Sultan Mehmet Kanunnamesi’nde, son olarak <br/>1858 yılında “Ceza Kanunname-i Hümayunu’nda düzenlenmiştir. Cumhuriyet <br/>dönemindeki kanunlaşma çabalarının sonucu 01.03.1926 tarihli ve 765 sayılı Türk <br/>Ceza Kanunu(TCK) m.448 ve devamında yer almıştır. Günümüzde ise 26.09.2004 <br/>tarihli ve 5237 sayılı TCK m.81’de bu suçun temel hali, TCK m.82’de ise nitelikli <br/>halleri düzenlenmiştir.Kasten öldürme suçu, yaşam hakkına yönelen saldırıların <br/>yaptırımı olup, bu suçun, doğru bir biçimde uygulanması için kuralların iyi bir biçimde <br/>belirlenmesi gerekir. Bu kapsamda bu çalışmada kasten öldürme suçunun temel ve <br/>nitelikli hallerine yer verilmiştir. Ayrıca, çalışmada bu suçun tarihsel gelişimi, bu suça <br/>ilişkin hukuka uygunluk sebepleri, kusurluluğa etki eden nedenler, suçta hata, suçun <br/>özel görünüş biçimleri ile bu suça dair soruşturma usulü ve yaptırım başlıkları ele <br/>alınmıştır. Çalışmanın ikinci bölümünde bu suçun nitelikli halleri ele alınmıştır. <br/>Tasarlama suretiyle, canavarca his ve eziyet çektirme suretiyle bu suçun işlenmesi, <br/>belirli akrabalara, çocuklar ve kendini savunamayacak halde olan kişiler aleyhine <br/>işlenmesi, kadına yönelik işlenmesi, kamu görevlisine yönelik işlenmesi gibi nitelikli <br/>haller ile bu nitelikli hallere ilişkin özel durumlara yer verilmiştir.<br/>Anahtar Kelimeler: Canavarca His, Hukuka Uygunluk Nedeni, Kasten Öldürme, <br/>Teşebbüs, Tasarlama |

ABSTRACT<br/>The crime of willful killing is as old as the history of humanity and took place in laws <br/>such as Roman, Egyptian, Hebrew and Islamic law in ancient law periods. In the <br/>Ottoman period, it was first regulated in the Fatih Sultan Mehmet Kanunnamesi, and <br/>lastly in the Imperial Criminal Code (Ceza Kanunname-I Hümayunu) dated 1858. It is <br/>regulated in articles 448 and the following of the Turkish Penal Code No. 765, dated <br/>1.3.1926, which came into force as a result of enactment efforts in the Republican <br/>period. However, today, in the Article 81 of the Turkish Penal Code dated 26.09.2004 <br/>and numbered 5237, the basic form of the crime of willful killing and its qualified <br/>forms are regulated in the Article 82 of the Turkish Penal Code.The crime of willful <br/>homicide is the sanction of attacks on the right to life, and the rules must be determined <br/>well in order for this crime to be implemented correctly. Therefore, in order for this <br/>crime, which is the sanction of attacks on the right to life, to be tried correctly, the <br/>rules must be determined well. In this context, the fundamental and qualified forms of <br/>willful homicide are included in this study. In addition, in this thesis, the historical <br/>progress of this crime, the reasons for compliance with the law regarding this crime, <br/>the reasons affecting the culpability, the error in the crime, the special appearance of <br/>the crime, the investigation procedure and the sanction headings related to this crime <br/>are handled. In the second section of the study, the qualified forms of this crime are <br/>handled. Qualified cases such as the commission of this crime by design, by inflicting <br/>monstrous feelings and torture, against certain relatives, children and persons who <br/>cannot defend themselves, against a pregnant woman, against a public official, and <br/>special cases related to these qualified cases are included.<br/>Keywords: Attempt, Contemplation, Lawfulness, Monstrous Feeling, Willful Murder |
