Institute of Graduate Studies and Research International Law Department Özet: ABSTRACT A continuing discussion is the culturalist relativist approach to human rights, particularly in Asia where cultural values and traditions are greatly valued. This essay seeks to assess this strategy from the standpoint of Asia. The fundamental ideas of cultural relativism are examined, as well as how they affect such human rights as freedom of speech, gender equality, and marriage. This study looks at the difficulties that the cultural relativist approach to the promotion and defense of human rights in Asia poses. It assesses the arguments in favour of and against the cultural relativist viewpoint and offers academic examples from several Asian nations, including China and Myanmar, to show how the viewpoint can be used to violate human rights. The study concludes by arguing that, while cultural values and traditions are important, they should not be used to justify violations of human rights. It suggests that human rights be regarded as universal and indivisible, and that cultural traditions and practices be reassessed to ensure that they do not violate human rights. This study also emphasizes the significance of regional protection mechanisms in promoting and defending human rights in Asia, and it advocates for the application of international human rights norms. This essay offers a critical assessment of Asia's cultural relativist approach to human rights. It emphasizes the significance of acknowledging the universality of human rights while also preserving cultural values and customs. This study stresses the importance of a balanced approach to human rights, one that takes cultural values and traditions into account while respecting human rights principles. This article indicates that regional protection mechanisms can play an important role in promoting and defending human rights in Asia, and it urges that international human rights norms be implemented. ABSTRACT
A continuing discussion is the culturalist relativist approach to human rights,
