Institute of Graduate Studies and Research International Law Department Özet: ABSTRACT As suggested by the title, “The Dilemma of State Recognition and the Case of Abkhazia”, this thesis is a contrast of legal theory and international relations. The title indicates two things, dilemmas of state recognition and the case of Abkhazia. Dilemma means any flaw, problem or loophole. The thesis sheds light on the concept of state recognition and the problems associated to it. Theoretically part of this thesis describes statehood, concept of sovereignty and theories of recognition of state. In explaining the concept of sovereignty main focus is on the views of Thomas Hobbes and Jean Bodin. Meanwhile Hegel’s theory is implied to elaborate the concept of state recognition and importance of recognition in modern era. The dissertation then discusses an unrecognised state, Abkhazia, as a case study. This example is further used to compare cases of other unrecognised states. This makes up the comparative part of thesis which is essential to prove the theme of this thesis i.e. the dilemmas of recognition. Comparative part highlights problem like flaws in theories of recognition and hypocritical practice of the international community. The thesis focuses on the applied law rather than philosophy. At the end the critique is done to explain the ill consequences of such practices and with the example of Abkhazia it is shown that state recognition is more of a political matter than a legal one. Thesis also shows that how Abkhazia, or any other unrecognised state, can fit into the parameters of recognition. At last suggestion and recommendations are given to for ending the stalemate and to free countries like Abkhazia from this political victimization. The thesis is completed using mixed methodology.
