520			_aÖZET İnsan hakları çerçevesinde bulunan “kişinin özel hayatının gizliliği hakkı” bireyin özel hayatına yönelecek bütün etkilere engel olunmasını talep etmesini kapsamaktadır. Devletlerarası sözleşmeler ve ulusal mevzuatta bireyin söz konusu hakları koruma altında bulunmaktadır. İnsan hakları sağlık alanında yer almaktadır ve “hasta hakları” olarak adlandırılmaktadır. İnsanların kişisel yaşam gizliliği hakkının sağlık alanına aksetmesi; “hastanın mahremiyet hakkı”dır. Mahremiyet hakkı, hukuksal açıdan Avrupa İnsan Hakları Sözleşmesi, Birleşmiş Milletler Medeni ve Siyasi Haklar Sözleşmesi ve Anayasa, Tıbbın Uygulanması ve Biyoloji açısından İnsan Hakları ve İnsan Haysiyetinin Korunmasına İlişkin Sözleşme’ye dayanmaktadır. Ne var ki, mahremiyet hakkının dikkate alınması beklentisi kimilerince var olan şartlarda bir lüks şeklinde görülse bile bu hak; evrensel hukuk ilkeleri, Türkiye Cumhuriyeti Anayasası, Kişisel Verilerin Korunması Hakkında Kanun ve Hasta Hakları Yönetmeliği tarafından teminat altına alınmıştır. Bu çerçevede mahremiyet hakkının ihlal edilmesi özel hayatın gizliliğine müdahale olup suç teşkil etmektedir. Hasta mahremiyeti hakkı, son yıllarda üzerinde çok tartışılan haklarından birisi haline gelmiştir. Literatürde hasta mahremiyetinin ihlali ve özel hayatın gizliliğine ilişkin pek çok araştırma vardır ve Türkiye’de günümüzde bu alandaki akademik incelemeler artmıştır. Sağlık Bakanlığı tarafından uygulanmaya başlanan kalite standartları kapsamında hasta mahremiyet hakkının korunması amacıyla yoğun çalışmalar yürütülmektedir. Bu çalışmada hasta hakları, mahremiyeti ve özel hayatın gizliliği konuları ile ilgili sorun ve çözüm önerilerinin sunulması amaçlanmıştır. 520			_aABSTRACT The "right to privacy of one's private life" within the framework of human rights includes the individual's request to be prevented from all effects on his private life. The said rights of the individual are under protection in interstate agreements and national legislation. Human rights are located in the field of health and are called “patient rights”. The reflection of the right to privacy in the field of health is the “patient's right to privacy”. The right to privacy is legally based on the European Convention on Human Rights, the United Nations Covenant on Civil and Political Rights, and the Convention for the Protection of Human Rights and Human Dignity in terms of the Constitution, the Practice of Medicine and Biology. However, although the expectation of taking into account the right to privacy is seen by some as a luxury in the existing conditions, this right; universal legal principles are guaranteed by the Constitution of the Republic of Turkey, the Law on the Protection of Personal Data and the Patient Rights Regulation. In this context, violating the right to privacy is an interference with the privacy of private life and constitutes a crime. The right to patient privacy has become one of the most discussed rights in recent years. There are many studies on the violation of patient privacy and privacy in the literature, and academic studies in this area have increased in Turkey today. Within the scope of the quality standards implemented by the Ministry of Health, intensive studies are carried out to protect the patient's right to privacy. In this study, it is aimed to present problems and solution suggestions regarding patient rights, privacy and privacy issues. Key Words: Patient, Patient Confidentiality, Privacy of Private Life.
